Trade law and trade flows

2019

This paper develops and estimates a model to study the effect of improving the quality of commercial trade law on trade flows. We focus on improvements aimed to privately resolve disputes among trading partners: international commercial arbitration and conciliation. The main novelty of the model is to explicit the balance between the contractual quality of importer and exporter (contractual distance) in an environment with informational frictions (contractual noise). Using a structural gravity estimation with high‐dimensional fixed effects, the main contribution of the empirical exercise is to confirm previous results and unravel new traits that align with our theoretical results. Arbitrati…

Integración: una cuestión de derechos

2010

This article achieves a comparative analysis between the Citizenship and Integration Programme (2007-2010) and the spanish Migration Bill Project. Firstly, it aims to analyze whether the concept of integration, as it was introduced as a general principle within the Migration Bill, is consistent with the concept of the Programme. Secondly, it is about to examine how the notion of integration affects some of the provisions, which are introduced by the law reform, especially on fundamental rights. Finally, this leads to assess the implications and strains between migration control policies and integration policies about migrants’.

Resemiotising text meanings. The UK Law Commission and the summary of consultation paper on surrogacy

2021

Modern legislative drafting theory urges legislative drafters in common law jurisdictions to bare the text from preliminary provisions and to start as early as possible with the regulatory message that the government is trying to convey to citizens. In line with the present legislation needs, the UK Law Commission Annual Report 2018-2019 states that “We have a statutory duty to promote the reform of the law and continue to work hard in this area”, alongside the production of graphics, infographics, images and pictures “to explain in plain English each new law reform project”. In this paper, O’Halloran et al.’s 2016 concept of intersemiotic translation, which takes place within and across th…

Un printemps social français

2016

In France, the spring of 2016 was marked by a number of demonstrations against the reform of the labour laws. The employers and the unions refused to discuss this reform which had been drawn up without any consultation. It pursues questionable objectives, in particular wanting to make the principal level of industrial relations take place at the level of the firm. Once again, despite a high level of social discontent, collective action was limited. This collective failure to act is mainly due to the institutionalization of trade unions and their financing by employers and the State.
